Initial Situation
Higher Mobility GmbH operated as a car hire company for high-quality (new) vehicles. To this end, it rented vehicles itself and sublet them throughout Europe, in some cases even outside of Europe. This resulted in cross-border tax conflicts, which led to unexpected financial burdens, payment defaults and the filing of an insolvency petition.
The Insolvency Proceedings
During the insolvency application proceedings, a reorganisation was attempted and negotiations were held with the main contractual partners. After this failed, Higher Mobility GmbH had to repatriate all vehicles within a few days. To this end, considerable efforts were made to recover vehicles outside Europe in a timely manner. This would not have been possible without the necessary and excellent cooperation between the management, the employees and the lessor and the provisional insolvency administrator.
The Result
All of the vehicles, which were scattered across the entire continent and had a value of several million euros, were secured and returned on site in the shortest possible time.
