SCHUFA now cancels residual debt relief after just six months

Ribnitz-Damgarten, 31 March 2023: In insolvency practice, insolvency administrators and trustees are repeatedly asked how long the insolvency is registered with SCHUFA.

The granting of residual debt discharge is published on the official internet portal for a period of six months. SCHUFA and other credit agencies, on the other hand, store the notices for three years.

Previous practice stood in the way of an economic restart

This storage period was met with incomprehension by many of those affected and, in the opinion of consumer associations and others, stood in the way of the economic restart intended by the discharge of residual debt. On 28 March 2023, SCHUFA announced that it would reduce the storage period for residual debt discharge to six months. To implement this, it has announced that all entries relating to a residual debt discharge that have been stored for longer than six months as of 28 March 2023 will be deleted after six months with retroactive effect from this date.

Deletion is automatic

This deletion is automatic; consumers do not need to take care of this. SCHUFA estimates that the technical implementation of the procedure will take around four weeks. BRRS partner and lawyer Nils Eggers welcomes the development: “This change will finally synchronise the deletion deadlines on the official internet portal and at SCHUFA.”
