The occasion: With its decision of April 28, 2022 (IX ZR 48/21), the BGH has further consolidated the new direction of case law on intentional avoidance since May 6, 2021 (IX ZR 72/20).
In focus: creditors under public law
In this respect, it concerns the possibilities of avoidance against social security institutions for contributions paid during the crisis. We want to take this decision as a starting point in order to shed light on the possibilities of avoidance vis-à-vis public-law creditors as a whole and, if necessary, to work out new aspects.
