3rd digital workshop by BRRS Rechtsanwälte on 26 April 2022
The IX Civil Senate of the Federal Court of Justice is continuing the reorientation of case law on avoidance with intent pursuant to section 133 InsO with great intensity. The 3rd Digital Workshop of BRRS Rechtsanwälte will focus on the two decisions of 3 March 2022 (IX ZR 53/19; IX ZR 78/20):
BGH IX ZR 78/20
In IX ZR 78/20, the IX Civil Senate distinguished, among other things, the reference point of intent under Section 133 InsO from Sections 15a, b InsO, so that the time limits and injunctions resulting from Sections 15a, b InsO do not determine the requirements for contesting intent. It has also been recognised there that intent can be assumed if the (future) creditors are deliberately burdened with the risk by an unsuitable restructuring attempt. According to this decision, lawyers, tax advisors and reorganisation consultants can be related parties of a debtor pursuant to Section 138 InsO.
IX ZR 53/19
In IX ZR 53/19, the BGH recognised, among other things, that over-indebtedness under insolvency law is an independent sign of evidence of intent to disadvantage and knowledge.
